THIS SECTION CONTAINS PERTINENT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS ANY LIMITATIONS AND EXCLUSIONS THAT APPLY TO THE WARRANTY BEING OFFERED BY IMAGEWISE FOR ANY PRODUCT BEING SOLD ON OUR WEBSITES.
These warranty terms and conditions (hereinafter referred to as the "Warranty") apply to your purchase of refurbished office equipment and related components, parts, materials, consumables and manual(s) (hereinafter referred to as "Product") by ImageWISE (hereinafter referred to as ImageWISE, image-wise.com ) and as included on the invoice page of the gotoimagewise.com image-wise.com , ePartsRoom.com websites and the acknowledgement or invoice provided to you by ImageWISE.
1. Warranty in Effect. Products purchased from ImageWISE include the Warranty as in effect on the date of invoice. This Warranty only applies to Product sold through our website and processed through our Web-based invoice system. Refer to the Warranty version and effective date as indicated on the invoice.
2. Warranty is Non-transferable. The ImageWISE Warranty is non-transferable. The Warranty is valid only to the end-user named on the invoice and shall remain valid only if the product remains at the original "ship to" address as indicated on the original ImageWISE invoice.
3. Warranty Limited to end-users located within the continuous 48 states of United States and Canada. The ImageWISE Warranty is specifically offered only to the end-user of the ImageWISE products and is specifically not offered to any wholesaler, reseller, dealer or any other purchaser who resells, leases or rents the product to an end-user or any end-user located outside the continuous 48 states of the United States and Canada.
4. Warranty Service - Labor. Warranty service which is to cover any labor charges when applicable, for the refurbished product that you purchase from ImageWISE must be pre-approved and scheduled through the ImageWISE customer service department prior to initiating any service call. Warranty service and any claim under this Warranty will be as directed and / or pre-approved by the ImageWISE customer service department. Service provided by ImageWISE in resolving any Warranty service claim will be performed by a service provider as determined and/or approved by ImageWISE. Payment for any labor charges covered under this Warranty will be paid directly to the service provider as approved by ImageWISE. Any labor performed by the service provider, beyond what has been pre-approved by the ImageWISE customer service department for the Warranty coverage will be separately invoiced by the service provider to the end-user and is to be paid by the end-user. Parts provided by ImageWISE in resolving any Warranty service claim may be new, equivalent-to-new, reconditioned or refurbished, as purchased from the Original Equipment Manufacturer (O.E.M.) or from an aftermarket source as determined by and at the sole discretion of ImageWISE.
5. Warranty Service - Parts. Warranty service which is to cover any parts charges when applicable, for the refurbished product that you purchase from ImageWISE must be pre-approved and scheduled through the ImageWISE customer service department prior to initiating any service call. Warranty service and any claim under this Warranty will be as directed and / or pre-approved by the ImageWISE customer service department. Any part(s) provided by ImageWISE in resolving a Warranty service claim are to be installed by a service provider as approved by ImageWISE. Any part(s) installed by the service provider, beyond what has been pre-approved by the ImageWISE customer service department for the Warranty coverage will be separately invoiced by the service provider to the end-user and is to be paid by the end-user. At the sole discretion of ImageWISE, any part(s) required to resolve a Warranty claim may require an exchange of the faulty part(s) currently included on the end-user's product. Parts provided by ImageWISE in resolving any Warranty service claim may be new, equivalent-to-new, reconditioned or refurbished, as purchased from the Original Equipment Manufacture (O.E.M.) or from an aftermarket source as determined by and at the sole discretion of ImageWISE.
6. Warranty Exchanges - Parts. The validity of any warranty claim involving a part(s) exchange for the refurbished product that you purchase from ImageWISE, when applicable, will be at the sole discretion of the ImageWISE customer service department. Upon pre-approval with the ImageWISE customer service department, any parts exchange will be made in accordance with ImageWISE's warranty parts exchange policy in effect on the date of your purchase and as included on your invoice. Any part(s) to be returned must include a Return Material Authorization (RMA) Number as provided by ImageWISE. Returning part(s) must be carefully packaged so as to arrive without damage. You are responsible for risk of loss and any shipping and handling fees associated with the return of the part(s) to be exchanged and while being sent back to us. If the part(s) arrive with any shipping damage caused by the lack of sufficient or appropriate packaging, then at the discretion of the ImageWISE customer service department, the warranty exchange will be deemed void. If you fail to follow the exchange instructions and policies provided by ImageWISE, ImageWISE is not responsible whatsoever for any part(s) that become lost or damaged in transit to us. If a part is being exchanged, the replacement part will be shipped to you once the part shipped to us by you has been received at ImageWISE. You are responsible for risk of loss, shipping and handling fees for the exchanged part(s) being shipped back to you. Any part(s) refurbished in repairing or servicing Product may be new, equivalent-to-new, reconditioned or refurbished as purchased from the Original Equipment Manufacture (O.E.M.) or from an aftermarket source as determined by and at the sole discretion of ImageWISE.
7. Warranty Exchanges – Copier / Fax. The validity of any warranty claim involving a copier or fax exchange for the refurbished product that you purchase from ImageWISE, when applicable, will be at the sole discretion of the ImageWISE customer service department. Upon pre-approval with the ImageWISE customer service department, any copier or fax exchange will be made in accordance with ImageWISE's warranty exchange policy in effect on the date of your purchase and as included on your invoice. Any copier or fax to be returned must include a Return Material Authorization (RMA) Number as provided by ImageWISE. Transportation of your copier or fax back to ImageWISE must be by a "High Value Equipment" carrier that utilize "Air-ride Trailers" and be insured for the original invoiced amount, plus freight cost. Returning copier or fax must be carefully packaged so as to arrive without damage. You are responsible for risk of loss and any shipping and handling fees associated with the return of the copier or fax to be exchanged and while being sent back to us. If the copier or fax arrives with any shipping damage caused by the lack of sufficient or appropriate packaging or if you have failed to provide adequate insurance coverage, then at the discretion of the ImageWISE customer service department, the warranty exchange will be deemed void. If you fail to follow the exchange instructions and policies provided by ImageWISE, ImageWISE is not responsible whatsoever for a copier or fax that becomes lost or damaged in transit to us. If a copier or fax is being exchanged, the replacement copier or fax will be shipped to you once the copier or fax shipped to us by you has been received at ImageWISE. You are responsible for shipping and handling fees for the exchanged copier or fax being shipped back to you. The exchanged copier or fax will include features that are at least equivalent-to the product originally purchased by you from ImageWISE and may be either reconditioned or refurbished as purchased from an aftermarket source as determined by and at the sole discretion of ImageWISE.
8. Warranty - Return Goods Policy - Copier or fax. The validity of any warranty claim involving the return of a copier or fax for either a credit or a refund will be at the sole discretion of the ImageWISE customer service department. Upon pre-approval with the ImageWISE customer service department, any copier or fax return will be made in accordance with the ImageWISE's warranty return goods policy in effect on the date of your purchase and as included on your invoice. Any copier or fax to be returned must include a Return Materials Authorization (RMA) Number as provided by ImageWISE. Transportation of your copier or fax back to ImageWISE must be by a "High Value Equipment" carrier that utilizes "Air-ride Trailers" and be insured for the original invoiced amount, plus freight cost. You are also responsible for any shipping and handling fees associated with the return of the copier or fax to be returned and while being sent back to us. Returning copier or fax must be carefully packaged so as to arrive without damage. You are responsible for risk of any shipping damage or other loss, or any subsequent shipping claim if such claim becomes necessary to cover any shipping damage or other loss. If the copier or fax arrives with any shipping damage caused by the lack of sufficient or appropriate packaging or if you have failed to provide adequate insurance coverage, then at the discretion of the ImageWISE customer service department, the warranty return will be deemed void. If you fail to follow the return goods instructions and policies provided by ImageWISE, it is understood and agreed that ImageWISE will not be responsible whatsoever for a copier or fax that becomes lost or damaged in transit to us. Any credit or refund as applicable; will be completed once the copier or fax shipped to us by you has been received at ImageWISE and has been deemed by us to be in the same or similar condition as it was, when it was originally shipped to you from ImageWISE. The returned copier or fax must be complete and include the entire equipment list as originally purchased from ImageWISE and as indicated on the Return Material Authorization as sent to you by ImageWISE. It is hereby understood and agreed by you, that you will not under any circumstances, initiate a credit card charge back from your cardholder due to either a warranty or shipping damage claim, and will instead follow the Warranty - Terms and Conditions as expressed herein.
9. Warranty Inclusions. No "Dead On Arrival". Refurbished Product purchased from ImageWISE, that arrives at the end-users address without shipping damage but is determined to be non-functioning (dead-on-arrival) will be repaired and/or otherwise restored to its fully functional condition by ImageWISE. When such a claim is made, ImageWISE will contract a local copier or fax technician to make any required repairs or adjustments. The 30-day tech support: From the date the product is received and for a period of 30-days thereafter, ImageWISE shall provide e-mail or phone tech support for answering service questions and/or resolving service related issues. Unfortunately, we do not offer product returns after the 10 day grace period on any products.
10. Limits of Liability. IMAGEWISE DOES NOT ACCEPT LIABILITY BEYOND THE REMEDIES SET FORTH HEREIN, INCLUDING BUT NOT LIMITED TO ANY LIABILITY FOR PRODUCT NOT BEING AVAILABLE FOR USE, LOST PROFITS, LOSS OF BUSINESS OR FOR LOST OR CORRUPTED DATA OR SOFTWARE, OR THE PROVISION OF SERVICES AND SUPPORT. EXCEPT AS EXPRESSLY PROVIDED HEREIN, IMAGEWISE WILL NOT BE LIABLE FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, OR PUNITIVE DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. YOU AGREE THAT FOR ANY LIABILITY RELATED TO THE PURCHASE OF PRODUCT, IMAGEWISE IS NOT LIABLE OR RESPONSIBLE FOR ANY AMOUNT OF DAMAGES ABOVE THE AMOUNT INVOICED FOR THE APPLICABLE PRODUCT. NOTWITHSTANDING ANYTHING IN THIS AGREEMENT TO THE CONTRARY, THE REMEDIES SET FORTH IN THIS AGREEMENT SHALL APPLY EVEN IF SUCH REMEDIES FAIL THEIR ESSENTIAL PURPOSE.
11. Governing Law. Purchaser agrees that the purchase from imageWISE, its affiliates or any of its online stores or web based portals occurs in Texas. Any disputes between imageWISE and Purchaser shall be governed by the laws of the State of Texas without regard to the provisions thereof which concern conflicts of laws. Purchaser agrees that any controversy arising between the Purchaser and imageWISE shall be litigated exclusively in Harris County, Texas. The state and federal courts and authorities with jurisdiction in Texas shall have exclusive jurisdiction over all controversies which shall arise between imageWISE and Purchaser. Purchaser irrevocably consents to service, jurisdiction, and venue of such courts for any such litigation and waives any other venue to which it might be entitled by virtue of domicile, residence or otherwise.
"The WISE 30" © 30-day Warranty: From the date the product is shipped and for a period of 30-days thereafter, ImageWISE shall provide a Warranty covering both parts and labor on the following Product and/or components:
- All main, accessory and external boards
- Motors, gears, drive belts and cables
- Document scanning bed (including exposure lamp)
- Fuser assembles (including relays and lamps)
- Paper transport system
- Paper drawers and large capacity cassettes
- Sensors, connectors and wiring harnesses
- Document feeder
- Duplex
- Sorter or finisher
- Print controller boards
- Fax board
- Hard drive, document server
"The WISE 120" © 120-day Warranty: From the date of shipment and for a period of 120-days thereafter,ImageWISE shall provide a Warranty covering parts on the following Product and/or components:
- All main, accessory and external boards (except print controller boards including EFI or Fiery)
- Motors, gears, drive belts and cables
- Document scanning bed (excluding exposure lamp)
- Fuser assembles (excluding relays and lamps)
- Paper transport system
- Paper drawers and large capacity cassettes
- Sensors, connectors and wiring harnesses
"The WISE 3 Year" © Three-year Warranty: From the date of shipment and for a period of two-years thereafter, ImageWISE shall provide a Warranty covering parts on the following Product and/or components:
- All main, accessory and external boards (except print controller boards including EFI or Fiery)
- Motors
- Document scanning bed (excluding exposure lamp)
- PCB Circuit boards (Not Damaged by Electric Surges)
12. Warranty exclusions. Excluded parts; The program exclusions include any service call charges (parts and/or labor) associated to problems or failures with consumable parts: Drum; cleaning blade; charge, transfer and separation rollers/wires; fuser pressure and heat rollers; fuser cleaning rollers/webs; bearings; feed tires; feed belts; separation fingers; developer, toner and fuser oil. Excluded services: The program exclusions include any service call charges (parts and/or labor) associated with certain situations: Service call costs relating to the Products initial set-up and configuration will not be covered by this warranty Service call costs relating to the Products print controller set-up and configuration, fax set-up and configuration, scan-to-network set-up and configuration, document server set-up and configuration, email server set-up and configuration, or any other non-copier or fax related feature set-up and configuration, will not be covered by this warranty Excluded causes: Warranty excludes any service call charges (parts and/or labor) caused by: Shipping damage or damage caused by transporting or otherwise moving the machine, Paper jams, Toner spills Coffee, food, drink, snack and water spills, Misuse, abuse, natural disasters or fire, The use of inferior quality paper, The use of inferior aftermarket toner, developer or other consumables.
13. "The WISE 10" © Guarantee is imageWISE’s 10 day Guarantee: established for the sole purpose of promoting safe and secure online purchasing of office equipment throughout the industry. Please note some Restrictions may apply. Contact your Sales Consultant for details. The Return Material Authorization (RMA) will be issued to any end-user, who has submitted a request for this special RMA in writing within ten days of the invoiced date of the copier or fax by IMAGEwise, under the following terms: Sufficient reason for requesting a return. No more than a combined total of 300 copies, prints or faxes have been added to the machines electronic copy count total(s), The end-user agrees to follow the provisions of the return policy described within Section 8 above, including but not limited to the use of an RMA, the careful repackaging and shipping procedure and full responsibility for any cost associated to the shipment of the machine. The end-user listed on the RMA may be subject to a restocking charge equal to 25% of the invoiced amount of the Product in addition to invoiced shipping charges. Any client wishing to receive the RMA should send us a written request to IMAGEwise c/o Returns,101 Esplanade Blvd Suite 400, Houston, TX 77060 ATT: Richard Martinez, to be received by ImageWISE prior to the tenth day of the product's invoice date. If your request is received by ImageWISE during this 10 day period, the Customer Support Department will submit your request to one of our Product Managers for review and at IMAGEwise's sole discretion issue an Return Material Authorization RMA with specific shipping and packaging instructions on how to return your merchandise, along with the provisions and requirements of our 10 day Returns Guarantee.
